The laws in the United States require that any employer who employs three or more full time workers should buy workers' compensation insurance, which covers any injuries that workers may sustain at jobsite or workplace. Such insurances are expensive and therefore, employers are not too happy to be buying such insurances.

The United States Department of Labor has instituted a federal agency called the
OSHA or the Occupational Safety and Health Management. This agency defines the safety norms for preventing accidents at workplace. Employers can avoid purchasing the workers compensation insurance as stipulated under laws if they conform to the regulations stipulated by OSHA.

OSHA's regulations also cover training that needs to be given to workforce to ensure their safety and the safety of their surroundings. For example, workers need to be taught how to handle any hazardous material, or any heavy load shifting equipment. Any such training should be periodically repeated so that the workers do not neglect such precautions. In addition to these, OSHA also stipulates the kind of equipment or clothing that may protect a worker from any workplace hazards. Therefore, at mining and construction sites, the workers have to wear the specific gear that protects them from injuries and other mishaps that can occur at these sites.

If any mishaps do occur, after all these precautions, the onus is still on the employer to ensure that the employee gets the required medical attention in time. This responsibility remains with the employer, even if the mishap is due to employee's carelessness. At this point, the extent of injury is assessed, and a written record is maintained, which will eventually be used in any court case, if the matter reaches there.

Accident reports contain several details about the employee such as his/her name, division under which he/she is working, and the nature of work that he/she was doing when he/she met with the workplace accident. Effectively, it helps the employers assess any shortfall in their training and rectify any problems, including replacing any faulty equipment.
